Terms Of Hire

Important: These terms form the agreement between us when you use our services. By ordering from us you automatically agree to abide by them.

Charging: The hirer will pay the charge stated on their invoice. Charges will continue until the equipment is restored to the Supplier in a serviceable condition. Any additional expense incurred by the Supplier in the recovery of the Equipment or any fees or expenses payable by the Hirer under this contract shall be payable by the Hirer. Payment of any lesser sum that the amount due shall not discharge the Hirers obligations under this agreement. (These monies will, if incurred, be taken out of the deposit).

Cancellation: Cancelled orders/items result in considerable cost/disruption and increased workloads for the supplier. An administration fee of 20% of the total order/item value is payable by the hirer regardless of the reason for cancellation. If the hirer re-books in the same season, the order will be re-instated with an automatic 20% discount.

Responsibilities of the Hirer: (i) The Hirer shall be responsible for the loading and unloading of the Equipment, and if assistance is required, any person supplied by the Supplier shall be deemed to be an employee of the Hirer or his agent. (ii) The Hirer's responsibility commences on the receipt of the Equipment by the Hirer, and ends when the supplier is in possession of all Equipment. (iii) The Hirer shall at all times and in all respects indemnify the Supplier against and from any and every expense, liability, financial loss, claim or proceedings whatsoever in respect of any personal injury whatsoever (including but without prejudice to the generality of the foregoing, injury to the Hirer and injury to any servant employee or agent of the Hirer) and in respect of damage to or loss of any property whatsoever arising out of or in connection with or consequent upon the hire, delivery, use, misuse, non-use, repossession, collection, return or non return of the equipment or any part thereof.

Maintenance of equipment: The Hirer shall keep themselves acquainted with the condition of the Equipment and ensure that it remains safe and serviceable. Any breakdown or any unsatisfactory working of the Equipment must be immediately notified to the Supplier. Under no circumstance shall the Hirer repair or attempt to repair the Equipment unless authorizedby the Supplier.

Consequential loss: The Supplier shall not be liable for any consequential loss to the Hirer including any expenses, liability, loss, claim or proceeding whatsoever caused by or arising out of the late delivery, non-delivery, unsuitability or lawful repossession of the Equipment, or any part thereof, or any breakdown or stoppage of same.

NON-RETURNED, LOST, STOLEN OR DAMAGED EQUIPMENT: (i) The Hirer accepts full responsibility for the care and safekeeping and return in good order of the Equipment. (ii) The Hirer will pay to the Supplier all costs incurred by the Supplier rectifying the condition of any Equipment returned damaged. Additionally, the Hirer will pay to the Supplier a charge equaling to the financial loss of the Supplier until such rectification is complete. (iii) In the case of Equipment which is lost or stolen or damaged beyond economic repair the Hirer shall in all cases meet the full cost of replacing the item. The Hirer's liability under this condition shall be without prejudice to any other rights of the Supplier.

Termination of hire: The Supplier shall be entitled at any time, if the Hirer is in breach of Contract, terminate this Contract (such termination to be effective immediately) and to repossess the Equipment or any part thereof.

Right of access: The Hirer hereby authorises the Supplier to enter upon the premises where the Supplier reasonably believes any Equipment or any part thereof, to be, insofar as the Supplier in his absolute discretion deemed necessary, so as to inspect, test, repair, replace or repossess the same.

Rights reserved: Any failure by the Supplier to enforce any or all of these conditions shall not be construed as a waiver of any of the Supplier's rights hereunder.
